Apple Trademarked "Multi-Touch"

Apple's press release announcing iPad availability contains the following:

iPad’s revolutionary Multi-Touch™ interface makes surfing the web an entirely new experience…

 

That's Multi-Touch (TM). I'm amazed it's possible to trademark that.

Note that they used TM and not R. The US Trademark law requires the use of TM on anything that you are asserting, or plan to assert a trademark registration for.

If you go to the USPTO (http://www.uspto.gov), you'll find that Apple's attempt to register this trademark has been refused by the Office and that they are appealing that refusal.

This isn't to say that they won't get the trademark, especially since much of the initial multi-touch work was done by the long-ago-acquired FigerWorks, but it's certainly not guaranteed.
